VicRoads Platforms and these Terms of Use

VicRoads provides a range of digital channels and services to help customers access information and complete transactions online.
VicRoads Platforms means the websites, mobile applications, online portals, digital services and social media channels operated by or on behalf of VicRoads, together with all content, features, functionality, services, tools and information made available through them.
Your access to and use of any VicRoads Platform is subject to these Terms of Use.
By registering an account on or using a VicRoads Platform, you accept and agree to be bound by these Terms of Use.
If you access or use a VicRoads Platform on behalf of a company, organisation or other entity, you represent that you are authorised to act on its behalf and to bind that entity to these Terms of Use.
References to "you" in these Terms of Use include both the individual accessing or using the VicRoads Platform and the entity on whose behalf that individual acts.
VicRoads may make changes to these Terms of Use from time to time. Please check this page regularly so you are aware of any changes, as they are binding on you.
Your Access to and Use of VicRoads Platforms
Unlawful or unauthorised uses
You may only access and use VicRoads Platforms for lawful purposes and in accordance with these Terms of Use.
You agree not to:
- upload, transmit or introduce any material that is unlawful, harmful, misleading, infringes another person's rights or privacy, or contains viruses, malware or other malicious code;
- use any robot, scraper, crawler, artificial intelligence tool, automated system or other means to access, extract, monitor, copy, collect, index, aggregate or use content or data from a VicRoads Platform without VicRoads' prior written consent;
- interfere with the operation, security or availability of a VicRoads Platform or attempt to gain unauthorised access to any part of it; or
- use a VicRoads Platform for any unlawful, fraudulent or misleading purpose.
Interruptions
VicRoads cannot guarantee your access to VicRoads Platforms will be continuous or uninterrupted.
We may amend or withdraw services or content available through VicRoads Platforms from time to time. We do our best to notify users of planned system outages.
Security
Protecting Your Account
Your privacy and security are important to us.
You must take reasonable steps to protect the security of your account including by:
- keeping your username, password, multi-factor authentication credentials and any other login, authentication or security details associated with your account secure and confidential;
- not allowing any other person to access or use your account;
- promptly notifying us if you suspect your credentials have been lost, stolen, compromised or used without authorisation; and
- exercising caution when accessing your account from a public, shared or unsecured device or network.
Transactions and Activities on Your Account
Until you notify VicRoads of a compromise, VicRoads may treat activities, instructions and transactions conducted using your authentication details as having been authorised by you.
Protecting Your Information
You should not send driver licence details, payment card details, banking credentials or other sensitive personal information to VicRoads by email, SMS or other unsecured messaging services. Where such information is required, VicRoads will provide or direct you to an appropriate secure channel.
System Security and Availability
While VicRoads takes reasonable steps to protect the security of information transmitted through VicRoads Platforms, no method of electronic transmission or storage is completely secure.
To the maximum extent permitted by law, VicRoads does not guarantee that information transmitted to or from a VicRoads Platform will be secure or free from unauthorised access; or a VicRoads Platform will be free from viruses, malware or other harmful components.
Access Monitoring, Restrictions, Termination
Monitoring
VicRoads may monitor access to and use of a VicRoads Platform and maintain records of transactions, activities and communications undertaken through it.
Access restrictions and suspension
VicRoads may suspend or restrict access to a VicRoads Platform where reasonably necessary to:
- protect customers or VicRoads systems;
- investigate suspected fraud, unauthorised activity, misuse of a VicRoads Platform, unauthorised harvesting of content or data, or breaches of these Terms of Use;
- respond to a security incident;
- verify a person's identity;
- prevent or address unauthorised transactions;
- comply with applicable laws or a lawful direction of a government authority; or
- protect the integrity, security or operation of a VicRoads Platform.
VicRoads may also use technological measures to monitor, prevent, restrict or block unauthorised access to or use of a VicRoads Platform, including automated access, scraping or other activities that may adversely affect the operation, security or integrity of a VicRoads Platform.
Termination
VicRoads may terminate your access to a VicRoads Platform where:
- you have engaged in unlawful, fraudulent or serious misuse of a VicRoads Platform;
- you have materially or repeatedly breached these Terms of Use or any applicable Service Terms;
- you have failed to remedy a breach of these Terms of Use within a reasonable period after being requested to do so by VicRoads (where the breach is capable of being remedied); or
- termination is reasonably necessary to comply with applicable law.
Notice
Where reasonably practicable, VicRoads will notify you of a suspension, restriction or termination and the reasons for it.
No exclusive remedy
Nothing in these Terms of Use limits any rights, remedies or causes of action available to VicRoads at law, in equity or under statute in relation to any unlawful use of a VicRoads Platform or breach of these Terms of Use.
Communications
VicRoads may communicate with you by email, SMS, in-app notifications or other electronic means in connection with your account, enquiries, transactions and use of VicRoads Platforms.
You are responsible for keeping your contact details, including your email address and mobile phone number, accurate and up to date.
With your consent, VicRoads may also send you marketing communications. You may opt out at any time using the unsubscribe facility included in the communication. Opting out of marketing communications will not affect service-related communications about your account, transactions or services.
Our content
Reliance on information provided
While every effort is made to ensure the information provided on VicRoads Platforms is accurate and up to date, we cannot guarantee that all content will always be completely comprehensive or error-free. If you spot any error or outdated content, we welcome your feedback.
Intellectual property
All rights in and to VicRoads Platforms and their content are reserved by VicRoads and its licensors.
Except as permitted under the Copyright Act 1968 (Cth) or other applicable laws, you must not reproduce, copy, modify, distribute, publish, frame, scrape, extract, commercialise, licence, sell or otherwise exploit any content, material, data or information available through a VicRoads Platform without VicRoads' prior written consent.
Nothing in these Terms of Use grants you any right to use VicRoads' trade marks, logos, branding or other proprietary material without VicRoads' prior written consent.
Additional VicRoads Services or Product-Specific Terms
Certain services or products available through a VicRoads Platform may be subject to additional terms.
Where additional terms apply, you will be presented with those terms at the time you access or use the relevant service. If there is any inconsistency between these Terms of Use and the additional terms, the additional terms prevail to the extent of the inconsistency.
Third Party Sites and Resources
VicRoads Platforms may contain links to websites, applications, content or services provided by third parties. These links are provided for convenience only. VicRoads does not control or accept responsibility for third-party content, services or websites, or for any loss or damage arising from your use of them.
Your use of third-party platforms, including social media platforms, is subject to the terms, policies and privacy practices of the relevant third party. We encourage you to review those documents before using their services or providing personal information.
Liability
To the fullest extent permitted by law and except as otherwise provided under these Terms of Use:
- subject to any rights that you may have under the Australian Consumer Law, VicRoads excludes all liability for any loss or damage of any kind, whether in contract, tort, under statute or otherwise, not caused by its negligence or fraud, including any loss or damage arising directly or indirectly from or in connection with any VicRoads Platform; and
- VicRoads’ liability to you for loss or damage of any kind will be reduced or limited to the extent (if any) caused or contributed to by you, your content, or any other matter outside our reasonable control.
Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law or any other applicable legislation that cannot be lawfully excluded or limited.
Privacy
VicRoads may collect, use, store and disclose personal information and other information about you when you access, use or interact with a VicRoads Platform, including when you create an account, complete transactions, make enquiries or use services available through a VicRoads Platform.
The information collected, the purposes for which it is used and the parties to whom it may be disclosed will depend on the relevant service, transaction or interaction. Where required, additional privacy notices or collection statements may be provided at the point of collection.
If you choose not to provide requested information, VicRoads may be unable to provide certain services, process transactions or respond to your request.
Further information about how VicRoads collects, uses, stores and discloses personal information, including how you may access or correct your personal information or make a privacy complaint, is available in the VicRoads Privacy policy.
If you provide personal information about another person, you represent that you are authorised to do so and have made that person aware of the matters referred to in the VicRoads Privacy Policy.
Severability
If any provision of these Terms of Use is held to be invalid, illegal or unenforceable, the remaining provisions continue in full force and effect.
Jurisdiction
These Terms of Use are governed by the laws of Victoria. The parties submit to the jurisdiction of the courts of Victoria.
